The project

Rapleys was appointed by Annington Property Limited to assist with their exit from office premises at 1 James Street, London and relocate to new premises. The instruction involved negotiating a dilapidations settlement regarding a claim which came in from the landlord at £309,492.50.

Our solution

We suspected the landlord may refurbish and upgrade the property, so as part of our negotiation strategy, we waited for the landlord’s intentions to crystalise before attempting to settle this claim. Eventually, we came across evidence online to put a reasoned supersession argument forward which managed to negotiate out of the claim all refurbishment elements. The residual claim for strip-out only as reduced to £140,000 which gave a significant saving of £169,492.50 or 45% of the original claim. A very successful result.
