The project
We were instructed by the church with regards to a scheme to provide a new church facility at ground and basement levels with residential flats above to pay for the new church plant. We had to advise that the project was very tight in terms of financial liability but through a tender process were able to negotiate terms with a contractor/developer to deliver the new church property at no cost to the client.
We were involved at all levels in ensuring the deal was negotiated on the best terms possible to the client to ensure compliance with the Charities Act 2011. They even received a small sum in overage as a result of the detailed terms we negotiated. We saw the project through to completion and were even involved in resolving any snagging issues post practical completion.
Our solution
- Advised client on project viability, which was very tight, hence having to subsequently lose the small basement
- Tendered to selected group of developers and negotiated detailed heads of terms to enable solicitors to draft the development agreement
- Provided a formal Qualified Surveyors Report to enable the client to meet their obligations under the provisions of the Charities Act 2011
- Advised on and negotiated terms for temporary accommodation during construction. This had to be done at short notice and entailed the need for a Licence Under Faculty as the temporary accommodation was in a local Anglican church
- Provided project monitoring during the construction period and post construction snagging to ensure the new church plant was delivered to the correct standard
- The church received a brand new facility at no cost and we even recouped their historic costs as part of the deal with the developer. They also received a small cash sum in overage following the sale of the last flat
