The project
Rapleys’ Commercial Agency team were instructed to sell this site on an unconditional on planning basis and needed to understand the impact of any potential Rights to Light issues impacting the future redevelopment of the site. Such a report would assist prospective purchasers in appraising value of the site and also allow our agency team to understand if the proper due diligence had been undertaken by prospective purchasers.
Rapleys’ Neighbourly Matters team were asked whether they could assist and advise on Rights to Light matters arising from a prospective redevelopment on the site.
Our solution
Rapleys’ Neighbourly Matters team were instructed to advise and began enquiring whether there were any restrictive covenants on the site. After confirmation was received this was not the case, the team arranged for a highly accurate laser scan of the site and the neighbouring properties with relevant apertures overlooking the site.
The ‘point-cloud’ data was used to construct a 3D model. Internal room layouts obtained via planning and online searches were then incorporated into the model.
A total of 181 rooms across 34 neighbouring properties were included within the scope of our analysis.
The team then applied specialist software to the 3D model in order to identify the Rights to Light constraints, leading to the compiling of an ‘envelope study’ highlighting the massing achievable on the site
The results confirmed considerable development potential (subject to planning etc) and enabling the vendor to achieve a more favourable sale price.
