The project

Rapleys were approached by South Gloucestershire Council in order to undertake a preliminary review regarding matters arising under the Party Wall etc Act 1996 from the proposals for the construction of a new railway station in Charfield, a town approximately 20 miles north of Bristol.

The project involves the assembly of multiple parcels of land within the ownership of 3 stakeholders comprising:

South Gloucestershire Council;
Network Rail; and
A local landowner

Rapleys were subsequently appointed to act and serve notification upon behalf of all the stakeholders.

The proposals included the construction of new buildings, a footbridge, two car parks and the forming of new entrances in and out of the site.

The site flanked various neighbouring properties of differing ages.

The new station is due to open in Spring 2027.

With Rapleys longstanding working relationship with Network Rail, besides being situated close to the site, we were well placed to assist with this project.

Rapleys delivered a highly professional service, simplifying and successfully helping to resolve a complex issue involving multiple parties and parcels of land. They were both responsive and attuned to the specific needs of the project throughout.

Our solution

Rapleys obtained copies of the proposals and undertook a site inspection, meeting various representatives on the project. Record photographs were taken of the boundaries and parcels of land which were changing hands during the project. This exercise led to undertaking HM Land Registry searches to identify all the relevant Adjoining Owners and titles.

We then compiled a Party Wall Tracker documenting the various Adjoining Owners, land titles and the items of notifiable works arising under the Act. Through further, extensive discussions between the various parties, a schedule of notices was compiled to ensure they were served at the correct time to the correct entity during the project.

This process involved the issuing of multiple notices with as many as 12 on a single day! Our careful planning paid off with all the relevant interests covered ensuring their statutory obligations had been fulfilled.
Additionally, Rapleys coordinated and undertook 15 inspections of neighbouring properties for risk management purposes, preparing photographic schedules of condition.
